New details about Ellsworth Co. officer-involved shooting


ELLSWORTH, Kan. (KSNW) – Ellsworth County Attorney Joe Shepack gave us new information about the officer-involved shooting in Ellsworth County last week.

Alberto Garcia-Tapia has since been released from the hospital. He’s charged with felony fleeing an officer, aggravated assault on an officer and felony DUI.

The county attorney said two deputies from Ellsworth County Sheriff’s Department and one officer from Ellsworth Police Department each fired their weapons at Garcia during a car chase, that started as a suspected DUI call.

Shepack declined to explain the circumstances around the shooting and what prompted officers to shoot.

He also declined to say how many rounds were shot.

The two deputies are currently on administrative leave. However, no information has been released about the police officer’s status.

Hollyrood Police Department was also involved in the car chase.

Shepack said Garcia was in court yesterday, wearing a neck and back brace. His right arm was in a cast, after being shot in the hand.

Garcia is in custody in Barton County.

His preliminary hearing will be held sometime in mid-October. Shepack says he plans to subpoena Garcia’s toxicology report from the Wichita hospital he was taken to after the shooting.

This is an ongoing investigation.
