WATERLOO, New York (WSTM) – Waterloo Village Judge Roger W. Barto has been hospitalized since Saturday after being attacked outside the Village Hall.

According Waterloo Judge Dean Mattoon, Barto was attacked as he was locking up the building at 10 p.m. Saturday night.

Mattoon says Barto had just completed an arraignment, but he does not feel the assault was related to the arraignment.

Mattoon says Barto was struck on the head from behind with the lid of a toilet tank that had been placed outside the building during renovations. Mattoon says Barto was also choked by his assailant.

Barto was taken to Strong Memorial Hospital in Rochester.

Mayor Ted Young says that he has been in touch with Barto’s family. He was told that Barto has been taken off a ventilator and is improving. Young says town employees are very concerned. “This is an incident that hits right close to home. He’s one of our employees, well known and liked in the village. We’re concerned about how something like this can happen and why it happened.”

Waterloo Police Officer James Chechak tells Kenyon that he was first to respond to the scene. He says Barto had regained consciousness immediately after the attack and called 911. Chechak says Barto told him that he believed there were two attackers.

Chechak says the judge slipped in and out of consciousness as he was being taken to the hospital by Finger Lakes Ambulance.

Waterloo Police Chief Doyle Marquart says they are following several leads in hopes of locating the assailant. Police do not have any indication of a motive for the attack at this time. Marquart says nothing was stolen from the Judge nor was there any evidence of a robbery attempt.
